General Terms of Conditions – Elite Detectors
1. Scope and Conclusion of Contract
These General Terms and Conditions apply to orders and purchase contracts with:

hereinafter referred to as “Elite Detectors”.
These Terms apply to consumers and business customers. Mandatory statutory provisions, particularly consumer protection provisions, remain unaffected.
The presentation of products in the online store does not constitute a binding offer by Elite Detectors. By completing the ordering process using the designated function indicating an obligation to pay, the customer submits a binding offer to purchase the products contained in the shopping cart.
An automatically generated order receipt confirmation only confirms receipt of the order and does not itself constitute acceptance. The order is accepted by an express order confirmation from Elite Detectors or by shipment of the goods, whichever occurs first.
2. Prices, Payment, Delivery and Shipping
The prices displayed or agreed at the time of ordering apply. VAT, shipping costs and other charges are displayed in accordance with applicable legal requirements.
The payment methods shown during checkout are available. In the case of bank transfer, payment is considered completed only when the funds have been credited to the account specified by Elite Detectors.
Delivery is made to the shipping address provided by the customer. The customer is responsible for providing complete and accurate shipping and contact information.
Delivery times may be affected by product availability, carriers, customs clearance, governmental measures or other circumstances outside the reasonable control of Elite Detectors. The customer's statutory rights in the event of delivery delays remain unaffected.
For deliveries to countries outside the European Union, customs duties, import taxes, clearance fees or other charges imposed by the destination country may apply. These are borne by the recipient unless expressly agreed otherwise.
For consumers, the risk of accidental loss or deterioration generally passes in accordance with statutory provisions only when the goods are handed over to the consumer or a person designated by the consumer to receive them.
3. Retention of Title
The goods remain the property of Elite Detectors until the purchase price has been paid in full.
4. Right of Withdrawal
Consumers have a statutory right of withdrawal where provided by law. Details concerning the requirements, deadlines, procedure and legal consequences are set out in the separate Elite Detectors Withdrawal Policy.
Beyond statutory rights, Elite Detectors does not provide an additional voluntary right to return or exchange goods that are free from defects.
The customer's statutory rights remain unaffected.
5. Statutory Defect Rights and Manufacturer Warranty
Statutory rights relating to defective goods apply. For new goods sold to consumers, the statutory limitation period for defect claims is generally two years from delivery.
Elite Detectors carefully checks devices before shipment and, where possible and appropriate for the particular device, verifies their condition and basic functions.
In the event of a technical problem, the customer should first contact Elite Detectors with the order number and a clear description of the issue. Photos, videos or additional information may be requested for assessment. Devices should not be returned without prior coordination.
Damage demonstrably caused by improper use, use contrary to the operating instructions, drops, impacts, liquids, other external influences, or unauthorized modifications or repairs does not constitute a defect for which Elite Detectors is responsible to the extent that the damage was caused by such circumstances.
In addition to statutory defect rights, devices sold by Elite Detectors are supplied with a two-year warranty card from the respective manufacturer. The respective manufacturer, not Elite Detectors, is the guarantor of this additional manufacturer warranty. Its scope and conditions are governed by the warranty terms of the respective manufacturer.
Elite Detectors assists customers with the manufacturer warranty process. The manufacturer warranty does not restrict the customer's statutory defect rights against Elite Detectors.
Where a product contains digital elements, the applicable statutory rights and obligations, including those concerning required updates, remain unaffected.
6. Detection Devices, Measurement Results and Use
Metal and gold detectors, ground scanners and other detection systems are technical search, measurement and analysis devices. Actual results may vary depending on factors including the device and search system, soil conditions, mineralization, moisture, electromagnetic influences, the type, material, size and location of the target, operation of the device, and environmental and field conditions.
Elite Detectors does not guarantee the discovery of gold, metals, treasures, cavities or any particular object, nor any particular search, excavation or economic success.
Information regarding detection depth, range, measurement results or other performance data based on manufacturer information must be understood in the context of the relevant manufacturer specifications and applicable testing and operating conditions. Actual results under real-world conditions may differ.
Scan images, 3D representations, measurement data and software-based evaluations are technical aids. They do not, by themselves, constitute binding confirmation of the actual presence, material, size, location or depth of an object.
Failure to achieve an expected search result, or difficulty operating a device due to insufficient knowledge or experience, does not by itself constitute a product defect where the device meets its contractual and statutory requirements.
Decisions concerning excavation, probing or other actions based on device results are the responsibility of the user. The user is also responsible for complying with applicable laws at the place of use and obtaining any required permits.
The customer's statutory rights in the event of an actually defective or non-conforming product remain unaffected.
7. Liability
Elite Detectors is liable in accordance with applicable statutory provisions.
Elite Detectors is not liable for damages or costs resulting from improper or unlawful use of the devices or from decisions made by the user based on their interpretation of search, scan or measurement results, insofar as Elite Detectors is not legally responsible for such damages or costs.
Mandatory statutory claims and liabilities remain unaffected.
8. Export Control, Applicable Law and Final Provisions
The sale, delivery or export of certain products may be subject to export-control, sanctions or foreign-trade restrictions. Elite Detectors is not required to process or ship an order where doing so would violate applicable legal prohibitions or binding restrictions. If an order cannot legally be fulfilled, payments already made will be handled in accordance with applicable law.
The law of the Federal Republic of Germany applies to the extent permitted by law. Where a consumer has their habitual residence in another country, mandatory consumer-protection provisions that cannot lawfully be excluded by a choice of law remain unaffected.
If any provision of these Terms is wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected. Where necessary, the applicable statutory provisions shall apply in place of the invalid provision.
